1. IT Act Section 79 Compliance
Lost & Found qualifies as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. This means that we provide a platform for third-party users to publish information related to lost and found items, but we do not initiate the transmission, select the receiver, or select or modify the information contained in the transmission.
2. Safe Harbor Protection
In accordance with Section 79 of the IT Act, Lost & Found is not legally liable for any third-party information, data, or communication link made available or hosted by us. This "safe harbor" protection applies because:
- We do not initiate the transmission.
- We do not select the receiver of the transmission.
- We do not select or modify the information contained in the transmission.
- We follow due diligence and observer guidelines prescribed by the Government of India.
3. User-Generated Content Responsibility
While we provide the platform, the responsibility for content rests solely with the user who uploads it. Users are required to ensure that their reports, images, and messages comply with our Content Policy and all applicable laws. We do not preview or endorse any content posted by our users.
4. Takedown & Compliance
As an intermediary, we are committed to responding to legitimate requests for content removal:
- Grievance Officer: We have appointed a Grievance Officer to handle complaints regarding content that violates the IT Rules.
- Takedown Requests: Upon receiving a valid court order or notification from a government agency, we will act expeditiously to remove or disable access to the offending content.
- User Reports: We also review reports from our community and may remove content that violates our internal policies.
5. Due Diligence
We observe due diligence as required by the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This includes informing our users of our terms and policies, and taking reasonable measures to ensure the platform is not used for illegal purposes.
